TERMS and CONDITIONS (T&C)

1. Introduction and interpretation
1.1 These terms and conditions (“Terms”) apply to all training courses provided by (“we” “us” or “our”) at Demidov Studio Vienna.
1.2 In these Terms, the following expressions have the following meanings:
“Application” means your application for a place on the Course, made via submitting through demidovstudiovienna.com;
“Course” means the course and mode of study set out on the Website in the course synopsis, to include for the avoidance of all doubt, Online Short Courses, or such alternative course that you and we subsequently agree that you will undertake;
“Event Outside Our Control” means an event or circumstances beyond our reasonable control, including extreme adverse weather conditions, power failure, loss of internet or poor connectivity, urgent or necessary maintenance that may arise from time to time, technical problems, strikes, and acts of god;
“Fees” means the tuition fees and administration fees payable by you in relation to the Course;

3. Bookings
3.1 Your Application is an offer to us to enter into a binding contract with us to purchase a place on the Course. We are free to accept or decline your Application at our absolute discretion.
3.2 At the point of our Confirmation, a contract will come into existence between us and you (the “Contract”). The Contract will continue until the completion of the Course, unless it is cancelled earlier in accordance with these Terms.
3.3 The Contract will be subject to these Terms and the Booking Form. We consider that these Terms and the Booking Form set out the entire agreement between you and us in relation to the Course.
3.4 Please check that the details in these Terms and the Booking form are complete and accurate. If you think that there is a mistake in the Terms or the Booking Form or that they do not contain relevant information that you are relying on, please notify us and ask us to confirm any agreed changes in writing before you submit your Application.
3.5 By registering, you affirm that you have proper health, accident, and liability insurance coverage.
4.The services
4.1 We will use our reasonable endeavours to ensure that the Services meet the description set out on our Website in all material respects.
4.2 We will use our reasonable endeavours to comply with the timetable for the delivery of the Services which is set out on our Website or otherwise agreed between us. However, you agree that dates and locations for delivery of the Services and the tutors and lecturers providing the Services may be subject to change from time to time.
4.3 We may make any changes to the Services which are necessary to ensure that they comply with any applicable law or satisfy requirement or which do not materially affect the nature or quality of the Services, and we will notify you of any such changes.
4.4 Disclaimer (Haftungsausschluss)
The Demidov Studio Vienna bears no responsibility for accidents, theft, or any form of damage that may occur on the premises, except in cases of intentional and gross negligence. If your undisciplined behavior results in potential damage to the premises or equipment, you assume full liability for any resulting property damage.
5. Fees and payment
5.1 The Fees payable are as published on the Website.
5.2 Fees are payable in EUR.
5.3 The Fees are payable at the same time as you submit your Booking Form. If asked to use a bank transfer on your invoice, the Fees have to be paid in full within three days of booking unless otherwise agreed upon (e.g. Payment Plan).
If we do not accept your booking, we will refund to you any Fees you have paid within 14 days of rejecting your booking.
5.4 If you do not pay the Fees in accordance with these Terms you will not be entitled to start the Course.
5.5 Fees can be paid by the following methods:
online by using your credit or debit card
via bank transfer;

we offer Payment Plans for certain Courses, which is detailed in the Course descriptions on our website. If you want to inquire about Payment Plans please contact us via office@demidovstudiovienna.com
5.7 Cancellation from participant
If you cancel your Contract 21 Days prior to the beginning of the Course, you will recieve a full refund. If you cancel 20 Days or less towards the beginning of the Course, you will not be entitled to a refund. If another participant takes on your space in the Course, you will get a full refund within 14 Days. We are not responsible to find a suitable replacement for you.
6. Minimum age requirement
6.1 We cannot accept your Application unless you are aged 18 or over, unless the Course is specifically advertised as being for persons under that age. By submitting your Application for any Course not advertised as being for persons under 18, you warrant that you are aged 18 or over. If this turns out to be incorrect, we will be entitled to cancel the Contract on written notice to you.
7. Intellectual Property
7.1 All course materials, including but not limited to syllabi, handouts, and instructional content, are the intellectual property of Demidov Studio Vienna.
7.2 Participants are prohibited from reproducing, distributing, or selling any course materials without explicit written consent from Demidov Studio Vienna.
7.3 Image Rights
All recordings (photos, audio, or video) are intended for the purpose of documentation and may be used for promotional activities. These activities encompass social media, print, and advertising. We commit to seeking your permission – photographic or video – prior to these being taken.
8. Code of Conduct
8.1 Participants are expected to conduct themselves in a professional and respectful manner during workshops and classes.
8.2 Discrimination, harassment, or any form of inappropriate behavior will not be tolerated.
9. Postponement of classes
9.1 If a class is postponed for reasons for which we are responsible, including staff illness, we will make every reasonable effort to reschedule the class or to add the missed hours on to the remaining Course classes. We apologise for this inconvenience and urge you to contact us if you have any concerns.
10. Non-attendance
10.1 Non-attendance at classes due to reasons other than our default does not entitle you to refunds, extra tuition or a transfer.
10.2 If, for reasons outside your reasonable control (such as illness) you miss classes, we will use our reasonable endeavours to offer you additional support, subject to you paying our additional charges.
11. Events outside our control
11.1 We shall not be responsible for any failure to perform or delay in performing our obligations under the Contract that is due to an Event Outside Our Control. If an Event Outside Our Control takes place which affects our obligations under the Contract then:
(a) we will contact you as soon as reasonably possible to notify you;
(b) our obligations under the Contract will be suspended and our time for performance extended for the duration of the Event Outside Our Control; and
(c) we will restart the Services as soon as possible when the Event Outside Our Control is over.
12. Our liability to you
12.1 If we fail to comply with the Contract, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Contract or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the Contract.
12.2 We do not exclude or limit in any way our liability for:
(a) death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
(b) fraud or fraudulent misrepresentation;
13. Data Privacy Statement
13.1 We keep records of participant names, addresses, and bookings for organisational purposes. This information will not be shared with any third parties. For more information see our Data Privacy Statement on our website.
14. Termination
14.1 We reserve us the right to terminate the participation of any participant who violates these Terms and Conditions or engages in disruptive or inappropriate behavior, without refund.
15. Amendments to Terms
15.1 These Terms and Conditions are subject to change. You will be notified of any amendments, and the revised terms will be made available on our website.
16. Governing Law
16.1 These Terms and Conditions are governed by Austrian law. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the Austrian courts.

17. Consent to Terms and Conditions
17.1 By enrolling in a workshop or acting class with Demidov Studio Vienna, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions.
